Banyule City Council Tree Regulations

Check Tree Regulations Before You Start

Before carrying out any major pruning or tree removal on your property, it’s important to follow Banyule City Council’s regulations for tree works.

These rules apply to properties in the following suburbs: Bellfield, Briar Hill, Eaglemont, Eltham, Heidelberg, Heidelberg Heights, Heidelberg West, Ivanhoe, Ivanhoe East, Lower Plenty, Montmorency, Rosanna, St Helena, Viewbank, Watsonia, Watsonia North, and Yallambie.

Parts of Bundoora, Eltham North, Greensborough, and Macleod also fall under Banyule City Council’s jurisdiction, so residents in these areas may also need to comply with these tree regulations.

Common Trees in Banyule City Council

The River Red Gum (Eucalyptus camaldulensis) and Yellow Box (Eucalyptus melliodora) are among the most commonly planted trees in the Banyule area. 

Banyule CIty Removal and Pruning Laws

 In Banyule, a permit is required to prune or remove a tree if it:

  • Is located within the Banyule Vegetation Protection Overlay zone
     
  • Is on a property with planning restrictions that prohibit or limit tree removal
     
  • Is listed on the Council’s Significant Tree Register
     

Additional Requirements:

  • Trees on developmental sites (construction sites, including extensions, sheds, or pools) require a separate arborist report.
     
  • On non-developmental sites, up to three trees can be assessed on-site for free by a council arborist. More than three trees will also require a separate arborist report. Our team at Treeincarnation can assist with this process.

Exemptions:
A permit may not be required if:

  • The tree poses an immediate risk to people or property (emergency work)
     
  • The tree is listed on the Department of Primary Industries noxious weed list
     
  • Work is performed by a qualified arborist (Certificate III or higher) in accordance with Australian Standards (AS 4373-2007) for Pruning Amenity Trees. For pruning, before-and-after photos must be taken to certify the work.
